TERMS AND CONDITIONS OF THE SKLEP JERZY ONLINE STORE

These Terms and Conditions are effective as of September 29, 2026.

§ 1. GENERAL PROVISIONS

1. The online store operating at https://sklep.jerzy.info.pl (hereinafter: the Store) is run by Lidia Nieboras, who conducts business under the name P.P.H.U. „JERZY” Lidia Nieboras, ul. Graniczna 3, 43-445 Dzięgielów, NIP: 548-144-87-21, REGON: 072256373 (hereinafter: Seller).

3. These Terms and Conditions set forth the rules for using the Store, placing and fulfilling orders, payments, delivery, cancellation of orders, and complaints.

4. All prices in the Store are listed in Polish zlotys (PLN); they are gross prices and include applicable VAT.

5. The information about the products posted in the Store constitutes an invitation to enter into a contract. The Customer’s placement of an order constitutes an offer to enter into a sales contract. An automated message confirming receipt of the order confirms that the order has been received. The contract is concluded when the Seller confirms acceptance of the order for fulfillment.

6. When announcing a price reduction, the Seller shall also display the lowest price in effect during the 30-day period prior to the reduction, in accordance with applicable regulations.

7. The Store offers both new and used items. The condition of each item is indicated on its product page.

8. The Terms and Conditions are made available free of charge in a format that allows them to be saved, viewed, and printed.

§ 2. DEFINITIONS

1. Customer – a natural person, a legal entity, or an organizational unit placing an order in the Store.

2. Consumer – a natural person who enters into a legal transaction with a business entity that is not directly related to the person’s business or professional activities.

3. A businessperson with consumer rights—a natural person who enters into a contract directly related to their business activities, provided that the terms of the contract indicate that the contract is not of a professional nature for that person.

4. Merchandise – a movable item offered for sale in the Store.

5. Business day – any day from Monday through Friday, excluding statutory holidays.

§ 3. ELECTRONIC SERVICES AND TECHNICAL REQUIREMENTS

1. The Seller provides the following services free of charge via electronic means:
– to allow users to browse the Store's offerings,
– managing your shopping cart and placing orders,
– creating and maintaining an optional customer account,
– providing access to contact forms and features related to order processing.

2. To use the Store, you need a device with Internet access, an up-to-date web browser, an active email address, and the necessary cookies and JavaScript enabled.

3. The Customer is required to use the Store in accordance with the law and generally accepted standards of conduct. It is prohibited to transmit unlawful content, attempt to disrupt the Store’s operation, or infringe upon the rights of third parties.

4. Creating a Customer Account is optional. Orders may be placed without registration. The Customer may request the deletion of their account at any time, subject to any data that the Seller is required or has a legitimate need to retain.

5. Complaints regarding the operation of electronic services may be submitted to sklep@jerzy.info.pl. The Seller will review the complaint without undue delay, no later than within 14 days.

§ 4. PLACING ORDERS

1. Orders can be placed through the website 24 hours a day.

2. The Customer selects the Product, the quantity, the delivery and payment methods, enters the required information, and accepts the Terms and Conditions. Before submitting the order, the Customer may correct the information entered and the contents of the shopping cart.

3. The customer receives an order confirmation and further information about the order's processing at the provided email address.

4. Order fulfillment depends on the availability of the Goods. If fulfillment proves impossible, the Seller will immediately notify the Customer and refund any payments received for the unfilled portion of the order.

5. In the case of a promotional sale or clearance sale, the order in which confirmed orders are received may determine the order in which they are fulfilled.

6. Contracts are concluded in Polish. The details of the order are recorded in the Store’s system and sent to the Customer via email.

§ 5. PAYMENTS

1. The available payment methods depend on the selected shipping method and are displayed at checkout each time.

2. The store accepts the following payment methods:
– online payment via Przelewy24, including BLIK, express transfer, and credit/debit card,
– traditional bank transfer,
– cash on delivery,
– payment by card or BLIK upon delivery, if this method is available for a given shipment,
– cash upon in-person pickup.

3. For a traditional bank transfer, please make the payment to the following account:
13 1050 1083 1000 0002 2127 3154 (ING Bank Śląski), entering the order number in the memo line.

4. Processing of orders paid in advance begins after the payment is confirmed by the payment processor or after the bank transfer is posted. Cash-on-delivery and in-store pickup orders are processed after they are accepted by the Seller.

5. The payment processor may apply its own terms and conditions and authorization methods. The merchant does not receive the full payment card details or the customer’s bank authentication information.

6. The Seller issues a sales document in accordance with applicable regulations and provides it in either paper or electronic form. Company information and the tax identification number (NIP) must be provided when placing the order if the Customer requests a business invoice.

§ 6. DELIVERY

1. Delivery is made to the address provided by the Customer or via in-store pickup at the store located at 3 Graniczna Street in Dzięgielów.

2. Current shipping costs within Poland:
– in-person pickup – 0 PLN,
– courier – bank transfer or Przelewy24 – 39 zł,
– courier – cash on delivery – 49 zł,
– Courier – payment by credit card or BLIK – 59 PLN.

3. Current shipping costs to supported European Union countries:
– EU courier – prepaid – 130 zł,
– EU courier – cash on delivery – 200 PLN.

4. The availability of each shipping method for a given address, the current cost, and the total order amount are displayed at checkout before the order is placed.

5. Shipments requiring special shipping conditions may be priced separately, subject to agreement with the Customer prior to processing.

6. The estimated preparation and delivery time may depend on the Goods, the delivery location, and the carrier. This information is provided to the Customer during the order fulfillment process. Unless otherwise agreed, the Goods will be delivered without undue delay, no later than the deadline specified by applicable regulations.

7. It is recommended that you inspect the package upon delivery. Filing a damage report makes it easier to pursue claims against the carrier, but the absence of such a report does not preclude the Customer’s rights against the Seller.

§ 7. RIGHT TO CANCEL THE CONTRACT

1. A consumer and a business with consumer rights may cancel a distance contract within 14 days without providing a reason.

2. The period begins on the date the Customer or a third party designated by the Customer (other than the carrier) takes possession of the Goods. In cases specified by law, the method of calculating the period may differ.

3. To meet the deadline, it is sufficient to send the statement before the deadline expires. The statement may be sent:

4. The Customer must return the Goods immediately, no later than 14 days after withdrawing from the contract. The Customer is responsible for the direct cost of the return.

5. The Seller shall refund the payments received, including the cost of the least expensive standard shipping method offered by the Store, no later than 14 days after receiving the notice. The Seller may withhold the refund until the Goods are received or proof of their return is provided.

6. Refunds will be issued using the same payment method the Customer used, unless the Customer expressly agrees to a different method that does not incur any costs for the Customer.

7. The customer is liable for any reduction in the value of the Goods resulting from use that goes beyond what is necessary to determine the nature, characteristics, and functionality of the Goods.

8. The right of withdrawal does not apply in the cases specified in Article 38 of the Consumer Rights Act, in particular with respect to non-prefabricated goods made according to the Customer’s specifications or intended to meet the Customer’s individualized needs, if such a situation arises.

§ 8. COMPLAINTS AND NONCONFORMITY OF GOODS WITH THE CONTRACT

1. The Seller is liable to Consumers and Entrepreneurs with consumer rights for any lack of conformity of the Goods with the contract, in accordance with the provisions of the Consumer Rights Act.

2. The Seller is liable for any lack of conformity existing at the time of delivery of the Goods and discovered within two years of that time.

3. The customer may request that the Goods be repaired or replaced. The seller may choose to replace the Goods instead of repairing them, or to repair them instead of replacing them, if the chosen method is not possible or would entail excessive costs.

4. The Customer may demand a price reduction or—in cases provided for by law—withdraw from the contract, in particular if the Seller refused to bring the Goods into conformity, failed to bring them into conformity, the lack of conformity persists or is so significant that it justifies an immediate price reduction or withdrawal.

5. The costs of repair or replacement, including postage, shipping, labor, and materials, shall be borne by the Seller in accordance with the provisions of law.

6. A complaint may be filed:

– in writing to the Seller's address.

7. The complaint should, to the extent possible, include the Customer’s information, the order number, a description of the problem, the Customer’s request, and any materials that will facilitate the resolution of the complaint. The absence of these elements does not deprive the Customer of their statutory rights.

8. The Seller shall respond to the Consumer’s complaint within 14 days of receiving it.

9. With respect to business entities that do not exercise consumer rights, the relevant provisions of the Civil Code and the agreements between the parties shall apply.

§ 9. PERSONAL INFORMATION AND COOKIES

1. The controller of personal data is Lidia Nieboras, who operates under the business name P.P.H.U. „JERZY” Lidia Nieboras.

2. The data is processed, in particular, for the purposes of entering into and fulfilling a contract, complying with legal obligations, handling complaints, and asserting or defending claims.

3. Detailed information about data processing, data recipients, retention periods, individual rights, and cookies can be found in the Privacy Policy available in the Store.

§ 10. OUT-OF-COURT DISPUTE RESOLUTION METHODS

1. The Seller strives to resolve disputes with Consumers amicably.

2. A consumer may seek assistance from a municipal or county consumer ombudsman, the relevant Provincial Trade Inspection Office, the permanent arbitration court attached to the Trade Inspection Office, or a consumer organization.

3. Information on out-of-court dispute resolution is available on the websites of the Office of Competition and Consumer Protection and the relevant ADR institutions.

§ 11. FINAL PROVISIONS

1. In matters not covered by these Terms and Conditions, Polish law shall apply, in particular the Civil Code, the Consumer Rights Act, the Act on the Provision of Electronic Services, and the provisions regarding the protection of personal data.

2. Any amendment to the Terms and Conditions does not affect customers’ acquired rights. For orders placed before the amendment takes effect, the Terms and Conditions in effect at the time the order was placed shall apply.

3. The provisions of these Terms and Conditions do not exclude or limit the mandatory rights of the Consumer or an Entrepreneur acting as a consumer.

4. Disputes with consumers shall be resolved by the courts having jurisdiction in accordance with applicable law. Disputes with businesses that do not exercise consumer rights shall be resolved by the court having jurisdiction over the Seller’s place of business, unless mandatory provisions of law provide otherwise.
